Pop Cult Trivia

• 1. Agreement to Terms
  These Terms of Service ("Terms") are a legal agreement between you and Pop Cult Trivia ("we," "us," or "our") governing your access to and use of our mobile application (the "App"), available on iOS and Android, and any related services (together, the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
• 2. Not Affiliated With or Endorsed by Referenced Parties
  Pop Cult Trivia is an independent entertainment app. Questions may reference movies, TV shows, music, celebrities, awards, events, brands, and other people and works for informational and trivia purposes only. Those people and rights holders, including studios, networks, record labels, streaming services, and award organizations, are not affiliated with, do not sponsor, and do not endorse Pop Cult Trivia. All trademarks, titles, and names belong to their respective owners.
• 3. Trivia Content and Accuracy
  Our questions are written and curated by our team, in part with AI-assisted tools, and are about fast-moving, current events. While we review questions before they go live, we do not guarantee that every question or answer is accurate, complete, or up to date, and facts may change after a question is published. We may correct, replace, or remove questions at any time, and may adjust scores, streaks, or rankings as a result. If you believe an answer is wrong, please let us know through our Contact page.
• 4. Quizzes and Leaderboards
  The daily quiz is available for one day and the weekly quiz for one week, based on Pacific Time. Once a quiz's day or week has ended, it locks and can no longer be answered. Scores, streaks, and rankings are calculated by the Service and are provided for entertainment only.

  • No prizes: Leaderboards and rankings do not carry any cash prize, reward, or other thing of value, and the Service is not a game of chance or a contest.
  • Fair play: You agree not to use bots, scripts, automation, multiple accounts, or any other means to gain an unfair advantage, or to manipulate scores, streaks, or rankings.
  • Enforcement: We may reset scores, remove players from leaderboards, or suspend accounts that we believe have violated these rules.
• 5. Eligibility
  You must be able to form a binding contract to use the Service. The App is not directed to children under 13 (or under 16 in the EU/EEA, where applicable), and use of the Service by anyone under those ages is not permitted without the consent and supervision of a parent or legal guardian, as required by applicable law.
• 6. Accounts and Usernames
  To use most features of the App, you must create an account using your phone number, which we use to send a one-time login code as described in our Privacy Policy. You are responsible for maintaining control of the phone number and device associated with your account, and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use of your account. Your username is shown publicly on the leaderboards. It must not be offensive, hateful, sexually explicit, or misleading, and must not impersonate another person, including any celebrity or public figure. We may change or remove any username that violates this section.
• 7. Subscriptions, Free Trials, and Billing
  A subscription is required to use the App; there is no free tier, although we may offer a free trial. The App is offered through auto-renewing subscriptions ("Subscriptions") purchased through the Apple App Store or Google Play Store (each, a "Platform"). By purchasing a Subscription, you authorize the applicable Platform to charge your chosen payment method.

  • Billing and Auto-Renewal: Subscriptions automatically renew for the same term unless you cancel at least 24 hours before the end of the current billing period. Your payment method will be charged for renewal through your Platform account.
  • Free Trials: If we offer a free trial, it will automatically convert to a paid Subscription at the end of the trial period unless you cancel before the trial ends.
  • Price Changes: We may change Subscription prices from time to time. Any price change will be communicated in advance and, where required by the applicable Platform, will require your consent before it takes effect.
  • Managing and Canceling: Subscriptions are managed through your Apple ID or Google Play account settings, not through Pop Cult Trivia directly. Deleting the App or your Pop Cult Trivia account does not cancel an active Subscription.

  All payments are processed by the applicable Platform, and their respective terms and payment policies also apply to your purchase.
• 8. Refunds
  All purchases are subject to the refund policies of the Platform through which you subscribed. Pop Cult Trivia does not process payments directly and cannot issue refunds. To request a refund, contact Apple or Google support in accordance with their respective refund policies.
• 9. Acceptable Use
  You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems
  • Copy, scrape, reverse engineer, or redistribute App content, including questions and answers, outside the App
  • Interfere with or disrupt the integrity or performance of the Service
  • Impersonate any person or misrepresent your affiliation with any person or entity

  We reserve the right to suspend or terminate accounts that violate this section.
• 10. Intellectual Property
  The App, including its software, design, questions, quiz content, and scoring methodology, is owned by Pop Cult Trivia or our licensors and is protected by copyright, trademark, and other intellectual property laws. Third-party names, titles, and trademarks referenced in questions remain the property of their respective owners. Except for the limited right to use the App for personal, non-commercial entertainment, we grant you no other rights in the Service.
• 11. Disclaimer of Warranties
  The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any question, answer, score, or ranking will be accurate or complete.
• 12. Limitation of Liability
  To the fullest extent permitted by law, Pop Cult Trivia and its officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from or related to your use of, or inability to use, the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us, if any, in the 12 months preceding the claim.
• 13. Termination
  You may stop using the Service and delete your account at any time through the App, as described in our Privacy Policy. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason, subject to applicable law.
• 14. Changes to the Service or These Terms
  We may modify or discontinue the Service, including any category, quiz format, or leaderboard, in whole or in part, at any time. We may also update these Terms from time to time to reflect changes in our practices or applicable law. We will update the "Last updated" date above and, for material changes, provide notice within the App. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
• 15. Governing Law
  These Terms are governed by the laws of the United States and the state in which Pop Cult Trivia is established, without regard to conflict of law principles, except where applicable local consumer protection law requires otherwise.
